Kpandai MP petitions Supreme Court to overturn election annulment

The Member of Parliament for Kpandai, Mathew Nyindam, has filed an application at the Supreme Court seeking to overturn a High Court ruling that annulled his 2024 parliamentary election victory.
Nyindam, through his lawyer Gary Nimako Marfo, argues that the High Court in Tamale wrongly assumed jurisdiction over a petition filed by NDC candidate Daniel Nsala Wakpal. Wakpal’s petition, which challenged the December 7, 2024 election results, was filed on January 25, 2025, which was 32 days after the results were gazetted on December 24, 2024. Nyindam maintains that the petition exceeded the 21-day statutory deadline set under Section 18 of the Representation of the People Law, 1992 (P.N.D.C.L. 284), rendering it invalid from the outset.
According to Nyindam’s affidavit, “The Parliamentary Election Petition filed by the 1st Interested Party on 25th January 2025, in respect of the Parliamentary Election held at the Kpandai Constituency on 7th December 2024, was invalid and could not have properly invoked the jurisdiction of the High Court, Commercial Division, Tamale."
On November 24, 2025, the High Court annulled the entire Kpandai election and ordered a rerun within 30 days. Nyindam is now seeking a judicial review in the form of certiorari to quash both the judgment and all related proceedings, insisting that the High Court acted without jurisdiction.
His legal team argues that allowing the ruling to stand would undermine the statutory limits governing election petitions and the proper administration of justice.
The Supreme Court is expected to hear the application on Tuesday, December 16, 2025.
Nyindam, the New Patriotic Party (NPP) candidate, was declared winner of the Kpandai contest with 27,947 votes (53.47%), ahead of Wakpal of the National Democratic Congress (NDC), who secured 24,213 votes (46.33%).
