The Court of Appeal has dismissed an application by Nana Appiah Mensah, also known as NAM1, which sought to suspend his ongoing criminal trial involving the defunct Menzgold Ghana Limited.
NAM1, who is facing multiple charges including selling gold without a license, defrauding by false pretence, money laundering, and breach of trust, had filed the application while appealing a High Court decision that compelled him to open his defence.
His legal team had petitioned the appellate court to stay proceedings at the High Court until the appeal was resolved. However, on Monday, May 19, 2025, state prosecutors pushed back, arguing that the application lacked merit and did not meet the legal threshold for halting the trial.
A three-member panel of the Court of Appeal comprising Justices Gbiel Suurbaareh (presiding), Afia Serwaa Asare-Botwe, and Christopher Archer unanimously ruled to dismiss the application.
The decision was welcomed by victims of the Menzgold collapse. Frederick Forson, a spokesperson for the aggrieved customers, described the ruling as a significant step toward justice for those who lost their investments.
Despite the setback, Nana Appiah Mensah is reportedly considering escalating the matter to the Supreme Court based on legal advice from his counsel.
