Busia Family sues Bono Regional House of Chiefs
8th August 2024
The Sofoase Yefere Royal Family of Wenchi, to which the Busia family belongs, has filed a judicial review application at the High Court in Sunyani.
The application, dated July 25, 2024, seeks a Mandamus order to compel the Judicial Committee of the Bono Regional House of Chiefs to constitute a panel to hear a long-standing chieftaincy petition.
The petition, filed on July 24, 2019, challenges the nomination of Mr. Abrefa Damoah as Wenchihene, citing unconstitutionality and contravention of the Chieftaincy Act, 2009 (Act 759).
Initially, the Bono Regional House of Chiefs granted an injunction, restraining Damoah from acting as Wenchihene. However, the National House of Chiefs later set aside the injunction and directed the Bono Regional House of Chiefs to expedite the hearing of the substantive case.
The Bono Regional House of Chiefs, presided over by Dormahene Nana Agyeman Badu II, is yet to constitute a panel to hear the case, prompting the Sofoase Yefere Royal Family to seek legal action. The High Court in Sunyani has adjourned the case to October 4, 2024.
Dr. Obeng Gyan Busia, Abusuapanin of the Sofoase Yefere Royal Family, filed the application through his counsel, Lawyer Kwabena Asare Atuah of Asamoah-Cheremeh Chambers.
