Lower tier side Tema Youth have been dealt a huge blow as the Court of Arbitration for Sport (CAS) has thrown out their request for a stay of execution in their legal tussle with the Ghana Football Association(GFA).

The club has been ordered by the Disciplinary Committee(DC) of the GFA to pay lower-tier side Young RedBull FC a mammoth €770000 following the transfer of Joseph Paintsil.

Tema Youth sent the matter to CAS after the Appeals Committee of the GFA upheld the decision of the Disciplinary Committee.

They filed for a stay of execution on the decision by the DC pending the hearing of the substantive matter.

The Division One League side averred that a stay was prudent as it was unlikely the Laussane-based court will come out with its ruling before the mandated 14 days by the Appeals Committee to pay the money expires.

But the apex sports judicial body disagreed stating that the appellant, Tema Youth did not file the statement of appeal brief until 1st July 2022 after the 14-day period had elapsed, meaning the appellant did not see their request as urgent.

The Deputy President of CAS Appeals Arbitration Division finds that the appellant failed to establish that it would suffer irreparable harm - leading to the decision to dismiss the stay of execution plea from the Ghanaian side.

"The request for a stay filed by Tema Youth Football Club on July 1 2022 in the matter CAS 2022/A/9010 Tema Youth Football Club vs. Ghana Football Association is dismissed." CAS ruling read.

"The cost of this Order shall be determined in the final award or in any other final disposition of this arbitration."

Tema Youth earned 3 million Euros from Belgian side KRC Genk for the transfer of the Black Stars winger in 2018.

Lower tier side Young RedBull FC who nurtured and honed the talents of the winger was due 30% of the transfer fee as part of their agreement with Tema Youth on the future transfer of  Joseph Paintsil.

Tema Youth failed to pay the stipulated 30% future sell-on fees on the transfer of Paintsil forcing the club to drag them before the Player Status Committee.

An agreement between Young RedBull FC and Tema Youth over the future transfer of Joseph Paintsil was reached in 2015 with Mr. Henry Acquah signing on behalf of Young RedBull whiles Mr Wilfred Kwaku Osei signed on behalf of his club Tema Youth.

Per the agreement, Tema Youth is to pay Young RedBull thirty percent of any future transfer fee of Joseph Paintsil to either a local or foreign club whiles Tema Youth will also take seventy percent.

In their petition filed with the Player Status Committee, Young RedBull avers that they have only been paid 121,193 euros from the transfer fee instead of the 900,000 euros.

Per the ruling, the Tema-based Division One League side was ordered to pay the outstanding balance of 778,807 euros to Red Bull FC within one month.
