Legal practitioner, Samson Lardy Anyenini has descended heavily on those criticizing the court for the sentence slapped on actress and social media sensation, Akuapem Poloo.

The actress was on Friday, April 16, slapped with a 90-day (3 months) jail term, by an Accra Circuit Court Judge on the charges of publication of obscene material and domestic violence.

Interestingly, social media users who earlier bashed her for the publication, are the same people crying  over her sentencing, with many describing it as  harsh.

But Mr Anyenini who maintains the 90-day sentence was fair, considering the magnitude of her charges, lashed at those engaged in the public outcry, schooling them on the laws of Ghana.

Mr Anyenini who is the host of Accra-based Joy FM's  Newsfile, shared his frustrations about the situation on the show's segment called; 'My Take' on Saturday, April 17 as monitored by Ghanaguardian.com.

According to him, those criticizing the actress' lawyer for advising her to change her not-guilty plea to guilty are only doing so out of ignorance, because that was the best decision the lawyer could have taken, considering the evidence in the possession of the prosecution, hence they should "leave her lawyer alone, because it could have been worse."

“Apparently she changed her plea, obviously upon advice, after she and her lawyer had been, as required by law, served with the evidence the prosecution was going to use for the trial. Tell me if you were also given those documents to examine or what informs your loud protest that she should not have pleaded guilty? The evidence must have included her public admission and apology video, how was she going to defend that? Leave her lawyer alone, because it could have been worse if she went through a trial and wasted the court’s and everybody’s time when she had a video admitting to the wrong.” He said.

He questioned all those describing the sentence as swift, asking them to produce cases of so-called powerful individuals who pleaded guilty in court but are walking freely.

“What did you want the court or judge to do after she pleaded guilty? So you can’t be saying it was swift, what exactly did you mean by it was too swift compared to other cases involving prominent people, which cases are you talking about and who has pleaded guilty and their case has not ended because they are powerful, connected or they are rich as you claim?"

An obviously upset Mr Anyenini questioned the actress' crusaders on when it became the job of the court "to go arresting people you claim must also be facing prosecution?", adding that,  "except for a capital offence, once an accused person pleads guilty, a Judge is legally and constitutionally bound to convict and pass sentence, that will be swifit."

Many were those questioning why the actress was remanded into custody after her conviction, when she was already on bail. Mr Anyenini questioned whether they wanted the rules changed just for the sake of the actress and urged the public to apply deep thinking and scruple to their public discourses.

"You really want the rules changed just for her and why? A suspect has been brought to court, she pleads guilty and has been convicted to wait for sentencing, and you are preaching the convict should be allowed to go home and not kept in the custody of the state? What will you think and say if she doesn’t show up for conviction? If anything happens, and/or she runs away, it’s this how you want convicts to be treated? Stop spewing absolute ignorance without deeper thoughts, or a scruple of principle."

On those advocating for a custodial sentence for the actress, the lawyer defended the court saying, the court was presented with the facts of the case, hence its final decision was ultimately based on the facts present.

"It [the court]  must have been aware of your uproar and shouts decrying her conduct and calling for action when she first published those pictures. What hypocrisy of a confused generation in dire need of principles, a  sense of decency and a scruple of morality. You shouted deal with her, she’s been dealt with, and even leniently and you say what?"

He prayed the actress' seven year old son, at the centre of this whole controversy will survive the potential effects of the situation.
