Counsel for Akosua Serwaa, wife of the late highlife legend Daddy Lumba, has announced that his client has instructed him to challenge the High Court ruling which recognised both Akosua Serwaa and Priscilla Ofori, popularly known as Odo Broni, as lawful spouses of the musician.
Speaking to Dadzie TV on November 28, 2025, lawyer William Kusi expressed strong dissatisfaction with the decision, describing aspects of it as troubling and unjust.
“I am a learned person, and I cannot align myself with decisions which are scandalous and I cannot defend. I just spoke with my client, and she said we should appeal against it, and I agree with her. We will prosecute an appeal,” he stated.
According to Kusi, after the judgment was delivered, he contacted Akosua Serwaa, who resides in Germany, and she directed that an appeal be filed once the full judgment—reported to exceed 70 pages—is officially released on December 1, 2025.
Explaining the basis of the court’s ruling, Kusi said the judge rejected the German marriage certificate presented by Akosua Serwaa on the grounds that it lacked the signatures of both parties. The court held that under German law, a marriage can only be proven by proper documentary evidence, not oral testimony.
Quoting the judge, Kusi said:
“She said Akosua Serwaa was unable to prove that she married Lumba in Germany. As for marriage in Germany, it is proven by documents, so if someone claims by just word of mouth that they got married in Germany, it’s not enough unless there is documentation. She added that the documents we brought to court cannot be accepted because Akosua Serwaa’s and Lumba’s signatures are not in them.”
Kusi further alleged that the judge suggested that the documents presented were forged, a comment he described as a direct attack on his professional integrity.
“The most scandalous part was when she said we only went to forge some documents to claim it is a certificate, which impugns our integrity as lawyers. To me, it is scandalous,” he added.
The Kumasi High Court ruling, delivered on November 28, 2025, declared that both Akosua Serwaa and Odo Broni remain the surviving wives of Daddy Lumba.
Akosua Serwaa had earlier sought a declaration naming her as the sole legal wife of the late musician, along with an injunction to restrain Odo Broni from presenting herself as such and to prevent the Ekuona family head from recognising her.
However, the court held that she failed to meet the evidentiary burden required by law. Presiding judge, Justice Dorinda Smith Arthur, ruled that the evidence presented “fell short of Sections 136 and 161,” noting that the plaintiff failed to submit the original marriage certificate from the Bornheim Marriage Registry, duly certified by the Ghana Embassy in Germany.
