The Supreme Court has dismissed a preliminary objection filed by the Attorney-General aimed at removing Justices Scott Pwamang, Adibu-Asiedu, and other committee members from a legal challenge brought by suspended Chief Justice Gertrude Torkonoo.

Deputy Attorney-General Dr. Justice Srem-Sai argued that the committee members were not explicitly named as defendants and should not be part of the case.

However, former Attorney-General Godfred Yeboah Dame, representing Justice Torkonoo, insisted that the reliefs sought directly affected the committee members, justifying their inclusion.

A five-member panel chaired by Acting Chief Justice Paul Baffoe-Bonnie ruled in Dame’s favour, allowing the committee members to remain as parties in the case.

Justice Torkonoo is contesting the constitutionality of the proceedings against her and has asked the court to permit her to waive her right to a private (in-camera) hearing.

She is also seeking a declaration that the committee’s prima facie finding is unconstitutional and a ruling to halt further proceedings by the committee.

The injunction is part of a larger legal battle challenging the constitutional grounds and procedures for her potential removal.
