Justice Torkornoo has right to contest dismissal— Dafeamekpor

Majority Chief Whip Rockson-Nelson Dafeamekpor says former Chief Justice Gertrude Araba Esaaba Sackey Torkornoo has every right to challenge her removal from office through the courts.

Justice Torkornoo was removed on Monday, September 1, 2025, following the provisions of Article 146(9) of the 1992 Constitution. A statement from the Presidency indicated that her dismissal was based on the recommendation of a committee set up under Article 146(6) to investigate a petition filed by a private citizen, Mr. Daniel Ofori. The removal took immediate effect.

Speaking on The Point of View on Channel One TV, Mr. Dafeamekpor emphasised that the former Chief Justice is legally entitled to contest the committee’s findings and recommendations in the Supreme Court.

“When Charlotte Osei [former Electoral Commission chairperson] was removed under Article 46 procedure, Kweku Baako [renowned journalist] went to the Supreme Court to challenge it. Isn’t it? The Chief Justice can go to the Supreme Court to challenge the findings and recommendations of the committee, which she has the right,” he said.

Mr. Dafeamekpor further stressed that removal under Article 146 does not necessarily mark the end of legal recourse for the affected official.

“Nobody should think that this is the end. Kweku Baako didn’t find favour with the court. It doesn’t mean that the findings of the committee cannot be challenged in the Supreme Court; it can,” he said.
